I love having a June birthday because it’s almost mid-year–a perfect time to reflect on my annual theme and goals. It’s also the month I started the business now known as Third Ear Conflict Resolution. This year will mark our 21st anniversary, and I chose Mindful Momentum as our theme. We’re building our next 20 years on the same simple vision to keep people out of court, which is evolving in wonderful ways I never imagined. Here’s what I can tell you so far.
Our Mediation Focus
Employment law and workplace disputes are what piqued my interest in practicing law, and that is the primary area where we are building momentum mindfully. We stay focused on this practice area also because it is a great equalizer.
Everyone has a job, has had a job, or knows someone with a job.

Resolving Workers Compensation Penalties
Unfortunately for employers, we don’t have to do much to build momentum in this area. Government data collection continues, agencies are sharing information, and penalties are being assessed. If you’ve received a penalty or inquiry notice from the NYS Workers Compensation Board, we will help you get in compliance and negotiate a reasonable penalty, if we can’t get it rescinded.
Investigating and Resolving Discrimination Claims
The new Title IX regulations are again adding challenges to college campuses across the nation. We know you can’t postpone your investigations of discrimination claims, including sexual harassment, while you get up to speed. Call on us if you need help with your overflow.
Training and Educating Professionals
Education and training remain vital to any organization’s mindful momentum, including ours. We have been aligning the programs I have been teaching since 2011 with best practices in adult learning. The KARR Method now guides the courses I deliver to attorneys, educators, funeral directors, and other professionals:

Even when they come primarily to get the credits they need to renew their licenses, I find ways to leave them with valuable information and skills.
Developing Values-Based Policies and Procedures
Despite the efforts to eliminate Diversity, Equity, and Inclusion (DEI) programs, employers are continuing to seek ways to:
- Put hurtful parts of their histories behind them
- Flatten their organizational structures
- Make them more inclusive
We are using mediation techniques to redesign their policies and procedures, weaving their values through each one. Additionally, we are working with managers to ensure they are communicating the values and expectations consistently. This has already reduced turnover and conflict in several workplaces, which is exactly what we set out to do. Now, they can mindfully build momentum, too. Life is good.
